Terms of Service

These Terms of Service ("Terms") govern the website design and related services provided by Jongoose Enterprises ("Jongoose," "we," "us") to you, the client ("you"). By purchasing a plan or paying an invoice, you agree to these Terms.

1. Free preview

We may build a free preview of a website for your business at no cost and with no obligation. The preview is a demonstration. We retain ownership of any preview until you purchase a plan. Preview pages may contain sample or placeholder text, images, and reviews for illustration only.

2. Services & pricing

Prices are in U.S. dollars. We may change prices for future purchases, but a change will not affect a Care Plan you are already subscribed to without notice.

3. Billing & payments

Payments are processed securely by Stripe; we never see or store your full card details. By subscribing to the Care Plan you authorize recurring monthly charges until you cancel. Failed payments may result in suspension of hosting and services after a reasonable notice period.

5. Your content & responsibilities

You are responsible for the accuracy, legality, and rights to any text, images, logos, or other content you provide or ask us to publish. You confirm you have permission to use that content. You agree not to use our services for anything unlawful, deceptive, or infringing.

6. Ownership

Once the Launch fee is paid, you own the final website and its content. Jongoose may display the finished site in its portfolio and marketing unless you ask us in writing not to. Third-party fonts, libraries, and services remain owned by their providers.

7. Timelines

We aim to take your site live within about two business days of payment and receiving the information we need from you. Timeframes are good-faith estimates, not guarantees, and may depend on your responsiveness, domain access, and third-party providers.

8. Hosting, security & availability

We provide hosting and security on a commercially reasonable, best-effort basis. We do not guarantee uninterrupted or error-free service, and we are not responsible for outages or issues caused by third-party hosts, domain registrars, or networks outside our control.

9. Limitation of liability

To the maximum extent permitted by law, Jongoose's total liability for any claim arising from these Terms or our services is limited to the amount you paid us in the three (3) months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or data.

10. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version. Continued use of our services after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in San Mateo County, California.
